Just a few days before the Maharashtra police conducted massive anti Naxals operation in which they arrested over 6 members who were said to be involved in inciting Bhima Koregaon violence and also plotting the assassination plan of Prime Minister Modi. Among them were Sudha Bharadwaj, Gautam Navlakha, Arun Ferreira, Vernon Gonsalves and P Varavara Rao, who were charged under the Unlawful Activities Prevention Act. The police seized numerous documents from their houses which confirmed that they had direct links with Maoists and Naxals.
But the Urban Naxals with the help of their political support, went to the Supreme Court against the arrest. Unfortunately, the Supreme Court questioned the police and ordered the police to keep them under house arrest instead of jail. But the Maharashtra police who challenged the petition claiming to have evidence of their link with Anti National activities have submitted an affidavit with all proof of the links with activists with Maoists.
The police in the affidavit said that they weren’t arrested because of their dissenting opinion against the government, but because of their involvement in anti-National activities. A 21-page affidavit has come a day before the hearing is to take place on a petition filed by Romila Thapar and four other activists. Rebutting the observation by the court that mere dissent in a democracy should not be punished, the state has said, “It is, however, submitted that the instant case is a case in which five accused persons for whose benefit the present petition is filed are not arrested based upon any dissenting expressed by them or difference in their political or other ideologies.”
The affidavit further states, “during the course of an intense investigation since the date on which the FIR is registered as pointed out herein, serious criminal offences are made out and incriminating material has emerged against them. This Hon’ble Court would be satisfied from the below-mentioned facts that, this Hon’ble Courtesy is not dealing with somebody ’s freedom of speech, freedom of conscience or freedom to hold and express views. This Hon’ble Court is dealing with persons against whom cogent evidence has so far come on record showing that they are active members of the banned terrorist organization namely, Communist Party of India [Maoist], and they are involved in not only planning and preparing for violence but were in the process of creating large-scale violence, destruction of property resulting into chaos in the society as per the agenda prepared by the Communist Party of India [Maoist], which was banned as a terrorist organization in 2009.”
The state said that the persons arrested along with the one absconding underground accused, as part of well thought out criminal conspiracy arranged public meetings under the banner of ‘Elgaar Parishad’. It appears clearly that “Elgaar” is a corrupted version of “Yalgaar” which means “the attack”.
The police said that the electronic materials and documents seized in their houses had information regarding supply of arms and ammunition to Naxals and helped them plan attacks against the armed forces. The activists showed their preparedness, planning and coordination with other activists to carry out a violent “ambush/rebellion against the enemy (which is our country and its security forces)”. “It would become amply clear that they are found to be committing and were planning and preparing for a series of criminal offences in connivance and conspiracy with other persons,” “Some of them have suggested training and laying of booby traps and directional mines. They are also found to be providing strategic inputs in furtherance of the objective of armed rebellion as per the strategic document of the banned terrorist organisation namely CPI (Maoist),” the affidavit added.
The police said that the lobby was involved in galvanizing and mobilizing the Naxals for various attacks, distributing money and helping them brainwash more people into left activism. The police filed a strong objection against petitioners defending the urban Naxals as strangers and said “The petitioners, who are strangers to the offence under investigation, are also praying for bail on behalf of the persons arrested during an ongoing investigation, strictly in accordance with the Code of Criminal Procedure after the investigating agencies having gathered requisite incriminating material against the said individuals”.
Now, with huge evidence against arrested members, it is most likely that they will be soon taken to police custody for further interrogation and investigation. This is exactly why the entire pseudo-liberal cadre has jumped into defensive mode claiming it is emergency like situation.
But in reality, it is a shame that those people who call themselves Human rights activists, Dalit activists are actually working for anti-National forces to destabilize the country and create rift between different sections of people.
